River Islands Development, LLC (“River Islands,” “we,” “us,” or “our”) operates the website riverislands.com (the “Site”) and the related email and SMS marketing programs (together, the “Services”). This Privacy Policy explains how we collect, use, disclose, and protect your personal information, including your rights under the California Consumer Privacy Act (CCPA) and its amendment, the California Privacy Rights Act (CPRA).

By using our Services, you agree to the collection and use of information as described in this policy. This policy is governed by the laws of the State of California.

2. Information We Collect

Under the CCPA/CPRA, the categories of personal information we have collected in the preceding 12 months are:

• Identifiers — name (first and last), email address, phone number, postal/zip code, and IP address.
• Customer records — any inquiry, message, or interest details you submit through our contact and interest forms (powered by Gravity Forms).
• Commercial information — records of homes, builders, or community features you’ve inquired about.
• Internet or network activity — browser type, device type, pages visited, referring URLs, time spent on pages, and interactions with embedded media (collected via server logs, Google Analytics, and similar tools).
• Geolocation data — approximate location inferred from IP address (not precise geolocation).
• Inferences — preferences and interests drawn from the above (e.g., interest in specific neighborhoods or home types).

Sensitive personal information. We do not collect sensitive personal information as defined by the CPRA (such as Social Security numbers, precise geolocation, account log-in credentials, racial or ethnic origin, or contents of mail/email/text messages).

Sources of Information

• Directly from you — contact and interest forms, SMS or email opt-ins, phone calls, and event registrations.
• Automatically — through your browser and device when you visit the Site (cookies, pixels, server logs).
• From service providers — analytics, hosting, form, email, and SMS platforms that help us operate the Services.

Third-Party Services That May Collect Information

• Google Analytics — measures Site usage. Google may collect your IP address and browsing behavior. See Google’s Privacy Policy.
• Google Tag Manager — manages tracking scripts on our Site.
• Google Fonts — your browser may transmit your IP address to Google’s servers when loading typefaces.
• Vimeo — embedded videos. Vimeo may collect your IP address and viewing data. See Vimeo’s Privacy Policy.
• WP Engine — site hosting. See WP Engine’s Privacy Policy.
• Gravity Forms — form submissions. See Gravity Forms’ Privacy Policy.
• Social Media Platforms — our Site links to profiles on Facebook, Instagram, Twitter/X, YouTube, LinkedIn, and Pinterest. Clicking these links may expose your data to those platforms’ privacy practices.

3. How We Use Your Information

• Respond to inquiries, contact form submissions, and interest requests.
• Provide information about River Islands homes, builders, amenities, schools, and community events.
• Send SMS and/or email marketing communications to users who have opted in.
• Analyze Site traffic and user behavior to improve our content and experience.
• Support advertising and retargeting campaigns (via Google and other platforms) — see Section 4 on Sharing.
• Share relevant information with affiliated companies — companies under common ownership or control with River Islands Development, LLC — for related real estate and community development purposes.
• Detect, prevent, and respond to security incidents, fraud, or unlawful activity.
• Comply with legal obligations.

4. How We Share Your Information

We do not sell your personal information for monetary compensation. However, under the CPRA, the term “sharing” includes disclosing personal information for cross-context behavioral advertising (for example, retargeting). To the extent our use of Google Analytics, Google Ads, and similar tools constitutes “sharing,” you have the right to opt out — see Section 7 and our Your Privacy Choices link in the Site footer.

We disclose personal information to the following categories of recipients:

• Affiliated Companies — River Islands may share your personal information with companies under common ownership or control with River Islands Development, LLC, for purposes consistent with this policy.
• Service Providers — vendors who help us operate the Services (e.g., WP Engine, Gravity Forms, email/SMS platforms), bound by contractual confidentiality and use-limitation obligations.
• Analytics & Advertising Providers — Google Analytics, Google Tag Manager, and advertising platforms may receive usage data per their own privacy policies. This may constitute “sharing” under CPRA.
• Legal Requirements — if required by law, court order, or to protect the rights, property, or safety of our organization or others.
• Business Transfers — in connection with a merger, acquisition, financing, or sale of assets, personal information may be transferred as part of the transaction.

5. Cookies & Tracking Technologies

When you first visit the Site, a consent banner lets you accept all cookies, deny non-essential cookies, or customize your choices by category. You can change your choices at any time using the Your Privacy Choices link in the Site footer, which reopens the same preference panel.

• Necessary — always active. WordPress, Gravity Forms, Elementor, and WP Rocket cookies required for the Site to load and function. These cannot be disabled.
• Functional — remember choices you’ve made, such as form entries or preferences.
• Analytical — Google Analytics, loaded via Google Tag Manager, to understand how the Site is used.
• Advertisement — tags that support advertising and retargeting campaigns on Google and other platforms. Enabling this category may constitute “sharing” under the CPRA (see Section 4).

Third-party embeds such as Vimeo and Google Fonts load according to the categories above. For a current list of cookies, see our Cookie Policy. You can also manage cookies through your browser settings; disabling certain cookies may affect Site functionality.

Global Privacy Control (GPC). We recognize and honor GPC browser signals as a valid request to opt out of the sale or sharing of personal information for users in California.

6. SMS & Email Marketing

• SMS Program. The River Islands SMS program sends messages about new homes, events, and community news. Message frequency varies (typically up to ~4 messages per month). Reply HELP for help, reply STOP to opt out at any time. Message and data rates may apply.
• Email. You may receive promotional emails. Unsubscribe at any time via the link in any email.

We do not share your SMS opt-in data or consent with third parties for their own marketing purposes. Consent to receive SMS is not a condition of purchase. For SMS program terms, see our Terms of Service.

7. Your California Privacy Rights (CCPA/CPRA)

If you are a California resident, you have the following rights:

• Right to Know — request disclosure of the categories and specific pieces of personal information we have collected, used, disclosed, or shared.
• Right to Delete — request deletion of personal information we have collected from you, subject to certain exceptions.
• Right to Correct — request correction of inaccurate personal information we maintain about you.
• Right to Opt Out of Sale or Sharing — although we do not sell personal information, you may opt out of “sharing” for cross-context behavioral advertising by using our Your Privacy Choices link, by enabling Global Privacy Control in your browser, or by contacting us as described below.
• Right to Limit Use of Sensitive Personal Information — we do not collect sensitive personal information beyond what is necessary to provide the Services, so there is currently nothing to limit.
• Right to Non-Discrimination — we will not discriminate against you for exercising your privacy rights.

Authorized Agents. You may designate an authorized agent to submit a request on your behalf. We will require written permission from you authorizing the agent and may also need to verify your identity directly.

Verification. To protect your information, we will verify your identity before fulfilling a request — typically by matching information you provide with information we already maintain (e.g., name, email, phone, and recent inquiry details).

Response Time. We will confirm receipt of your request within 10 business days and respond substantively within 45 days as required by California law. When reasonably necessary, we may extend the response window by an additional 45 days and will notify you of the extension and the reason.

8. Data Retention

We retain personal information only as long as reasonably necessary for the purposes described in this policy. Typical retention periods:

• Contact & inquiry form submissions — up to 3 years after your last interaction with us, then deleted or anonymized.
• SMS and email marketing data — until you opt out, plus a short suppression period (typically 1 year) to honor your opt-out.
• Analytics and usage data — up to 26 months in Google Analytics, then automatically deleted or aggregated.
• Records required for legal or tax compliance — retained for the period required by applicable law.

You may request deletion at any time (see Section 7).

9. Children’s Privacy

Our Services are not directed to children under 13, and we do not knowingly collect personal information from them. In addition, we do not knowingly sell or share for cross-context behavioral advertising any personal information of consumers under 16 without the affirmative opt-in required by the CPRA. 10. Links to Third-Party Sites

Our Site may link to external sites, including builder websites, the City of Lathrop, and school district pages. We are not responsible for the privacy practices or content of those third-party sites.

11. International Users

Our Services are operated in the United States. If you access the Services from outside the U.S., please be aware that information you provide may be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your country.

12. Changes to This Policy

We may update this Privacy Policy as our Services or legal requirements change. The “Last Updated” date at the top of this page reflects the most recent revision. Material changes will be communicated through a notice on the Site or, where appropriate, by email. Please review periodically.
